While it's likely McFarland has the negatives (if not the original art, as was the case with Miracleman) he wouldn't legally be able to publish it without an agreement with the Tolkien estate.

They'd never actually get the rights to do Hobbit/LotR/Silmarillion off Chris Tolkien unless it was nothing other than a completely straight-up adaptation, probably with him overseeing it, and even that's still unlikely.
What's more likely is that they could get away with doing a LotR comic based on the movies (which is the same reasoning with what Shadows of Mordor was made, even though that game butchered Tolkien's lore horribly), but even then I doubt many DC writers honestly have that much affection for Tolkien's work anyhow, save unless they got Gaiman on it.
