Really it's a type of custard, and if you bake it in a crust then it's a custard pie. Not a cake at all though. It has a crust and a filling, and is not based on a flour-based batter. It's not fluffy like a cake, in fact, there you go. Cakes are made with a spongy dough. Every single one. Pies are crust + filling, every single one. Filling is irrelevant.

It's a pie if it is entirely enclosed in a crust, minus the operating crust roof. Anything with an enclosing crust is a pie.
