You can get metal BB's but you can kill an animal with plastic BB's too. I went to this one dudes birthday party at a park where he got a BB gun as a present. He shot a bird with it and killed. After he kept shooting it he managed to disembowl it so it goes to show you can do plenty of damage with them.

Listen, OP, you have several options. First is to call up your local county State's Attorney and tell them you'd like to press charges. If that fails, threaten to go to the local paper with it. I understand cops can be pricks. However, unlike the police, prosecutors have to worry about re-election. So I think you'd have a lot more luck trying that avenue.
