>Ignorantia juris non excusat[1] or ignorantia legis neminem excusat[2] (Latin for "ignorance of the law excuses not"[1] and "ignorance of law excuses no one"[2] respectively) is a legal principle holding that a person who is unaware of a law may not escape liability for violating that law merely because he or she was unaware of its content.

That's true, but there's also something called "prosecutorial discretion", meaning the feds don't have to do shit about Hillary if they don't feel like it or if they think there isn't a case to be made.

mens rea is required for the action she committed to be a crime

not all crimes require mens rea, but the one she is accused of does, and if a republican fbi head decides not to recommend charges she has no chance of being convicted

boom. nailed it. all these arm-chair quarterbacks saying what should have happened, like they know shit.
>>
Damage arising from gross negligence is still the responsibility of the perpetrator. Federal law is actually being completely re-written when they say "no real INTENT to harm the country, so no indictment". If you run down someone running through a red light because you were texting but had "no intent to harm" guess how you would do defending that?

>>
>>693222446

No, it doesn't. There is a separate law dealing with misuse of classified material in a manner to hurt the US; hers was a crime of wilful incompetence, which is not an excuse.

She is guilty. The fix is in.

>>
>>693231420
And she KNOWINGLY used her own, unauthorized private server. Your point?
>>
>>693229598
Let's go with your example.
3am on a deserted street, you're driving around with national secrets taped up on the windows of your car. Now, having them there instead of, say in a locked case in the trunk, would seem pretty negligent.

You run a red light, and even though nobody got hurt immediately, the camera taking a picture of your plate also got a good look at the military secrets plastered out there in the public.

Regardless of all of that, the law is that you don't run red lights. You ran a red light, its documented by the camera. You should expect a fine and points on your license, even though 'nobody got hurt'.

Show the malice.
Show the harm.
She is an idiot or fool at the least.
But show us, oh enlightened one where there was harm to warrant 1100 FBI agents assigned to this.
You "conservatives" have no issue wasting gov't resources when its against your adversaries.
>>

I rolled a stop sign without malice or harm. Still got fined.
>>
>>693233177
Keep making my point for me.
FOCUS on the nut job, criminal, whatever.
STOP trying to ban "assault weapons" and "high capacity" magazine.
In other words: properly allocate resources

I think it's a good idea, but execution will be difficult. 2a isn't a complicated amendment but look how much it has been parsed or ignored.
Writing an amendment about "orlando shooter nuts" would be hell.

>>693235922
Never said it would be easy, or even possible. But it should be a starting point for both sides of the debate.

If you have time could you all please take and share this poll: http://www.strawpoll.me/10677417
>>
>>693233977

No intent is necessary for violation of the law cited.

All you need is to show 'gross negligence'

Would have been a slam dunk case.
>>
>>693237528
Obviously not a slam dunk, or there...oh wait sorry it was another conspiracy.
Care to address the rest of my post, or too much for you to process?
>>
>>693233977
I'll share a little something with you.

I have a car, like most middle-class citizens.
My car has been needing repairs. So I found a local job that I can walk to.
My car had been sitting for months. So I canceled the insurance.
The father of a friend of mine offered to help with repairs.
I cant do some of the repairs because I live in an apartment and they dont allow such extensive work done in the lot.
All I had to do was drive the car 1/2 mile. That was it. I left at 1am, when no one should be on the road.

I was pulled over for a routine DUI check. Unknown to me at the time, they are now asking for proof of insurance instead of registration. I cooperated, was respectful, and let them know where I was going and why. The officer took pity and I was escorted back to the apartment complex. And was still ticketed. I was able to keep my car. I was still ticketed.

I fought it, and no luck.

Now, my license is revoked. I paid the $370 citation, and have another $680 simply to get it reinstated, on top of any other filing fees. at least it won't go down as a criminal offence.

YOU show me the fucking malice.
YOU show me the fucking harm.

Oh wise one.
>>
>>693239531
What i'm trying to show you is, that if your story is factually true, you should not be cited. i've been "excused" traffic infractions that I've actually committed. Did the cop "follow the law" or the "spirit of the law"?
So do you want "justice" by the book, or by what is right?
