The police report was a slam dunk too. Driver basically admitted fault and an independent witness verified everything.

What's new here? People have to get out of the mindset that insurance company reps are there to help. Insurance companies are in the business of making money. The sooner you understand this, the less frustrated you can be at them for doing what they do.

It's also in your best interest to get a lawyer any time you're in a collision, and any time you have to speak with police. Police are not there to help you if you're possibly at fault.

It's more that we weren't far apart in our numbers and the insurance company seems ready and willing to roll the dice on a case they're likely to lose, a case with the possibility of punitive damages to boot (given the claim of recklessness) -- all over $2,000.

For example if the driver admitted to smoking weed, driving under the influence, speeding, and running a red light -- all of which are true in my case -- that's recklessness. Not just negligence where causing harm is POSSIBLE but recklessness, LIKELY to cause harm.

We've got a strong case and I think the insurance company knows that. They'll settle once they see the suit and realize we're serious.
