In R v Clarke (1927)
The West Australian government posted a reward for information leading to the conviction of murderers who had killed policeman. Clarke, under suspicion, gave information that led to the capture of the murderers. He knew about the reward but admitted it was not thinking about it when he gave the information.
The Government’s reward was an offer. In order to complete the contract it would need to be accepted. His mind on his release, Clarke was not responding to the offer when he gave the police information. He had not made an agreement, and the High Court held he had no contractual right to the reward.
