Tor is the dark web, not the deep web. Deep web is just hidden sites on the clearnets that aren't indexed by google. Darknets are ones that hide their IP addresses and exist on Tor and so forth.

I don't think using tor alone will get you on the fbi watchlist, because there would simply be too many people to watch - even if they could figure out who you are and where you were coming from.
