Characters have the same names and generally strikingly similar personalities, entire plotlines have the same arcs, the setting is the same, even the name of the first book is the same. What you don't have is a story told from a dozen POVs each season, so we get the real, unbiased story from the camera unless it happens offscreen and we're told by a 3rd party.

There's really no international claims courts. Hell, there's barely international criminal tribunals. International law is really fucky without a single figurehead to bring it under one authority, like a federation of all nations. At best, there are alliances and coalitions that only meet when the perpetrator and victim are members and they can somehow enforce their ruling. Jon and Danearys are the two main characters of the books. All the others Tyrion included are side characters used for fleshing out the world and providing external perspective.
Undead Jon could never be a Hero or Azor Ahai or The prince that was promiosed.
The purpose of his death is for it to free him from his black brother vows. Its a symbolic death. If he really died the story so far would be meaningless.
