If you are filming or engaging on private property, yes. If you are doing so from public property, no. If you are caught taking a picture that would breach someone's reasonable expectation of privacy (ie- taking upskirts) then you could be charged with sexual harassment. Breach of someone's privacy does not mean their face can't be in the picture. You also may NOT distribute the image to any media to make a profit, this includes websites that require payment for a subscription.
All that being said, if you are caught filming someone in public, you are protected by the 4th amendment in that they are NOT entitled to view your camera/phone for proof that you filmed/snapped them. Because your photography falls under the 1st amendment and the right to free speech outweighs the right to privacy. Which also means that even if they complain to a police officer or file a complaint to the department that they can't open an investigation against you. HOWEVER, don't be a dumbass - if someone suspects you're creeping around, before you know it they might start filming YOU, and you'll be subject to the internet's judgment like the people you took pics of.
In short, what I can tell you is this - don't get greedy. Seriously, it's not worth getting into trouble to get that one shot. There will always be another day and another woman who will catch your eye.

I've found that you don't have to tear into them with words - just be firm with your body language. Or I'd just say a simple sentence like "that's my sister". You don't even have to look angry. Then they'd recoil, show me their phone (didn't ask to see it) to show they were deleting the offending image/video. More of a stern warning than anything. Because seriously, you never know if you'll cross paths with them again and the script is flipped, you want SOME good will with them.
