The decision to fire me had been made beforehand and I wasn't given a say in the matter. Nor was I allowed to see the emails in question because they don't exist.

They gave me a check for my salary this month up till today and cashed out my vacation time.

The HR representative said that they would give me a payment equal to two months salary if I signed some form that they would mail to me. If I accepted I would be banned from all university property for the rest of my life. (I work at a research lab affiliated with a school)

Well, depends on where you live. In an 'at will' state they can fire you for any reason or no reason. If you apply for unemployment benefits and the university denies them, the Labor Board may ask to see relevant documents in the case and shoe just cause.

About two or three weeks ago I literally sent my group leader an email asking if they wanted me to leave the group and/or the lab. I had been hearing the drum beat to leave for months now and I knew something was coming. I wanted to jump to another group and not be fired. I had literally emailed another group leader asking about an open position a few hours before this came down.

I don't know that it is illegal per se. It is more to avoid being sued for in case the former employee sues for defamation. An previous employer can also be found liable if they are aware of certain behaviors and fail to disclose them, violent behavior for example.

It really all depends on what state you are in how much liability you face.

About two weeks ago I met with the associate group leader who said that "it's ok to think about rape and murder but you need to be careful with what you put in writing." This statement didn't make sense to me and I pressed him on it. At this point it seems very much like foreshadowing that he was going to fuck me over.

Good move. Between now and then - document everything as well as you can with the resources you have (work laptop etc) if your account has not been disabled yet.

Go a step further by recording yourself doing this, confirming day and time at the start - even with just a cell phone. This is important so if they claim you continued to send correspondence after termination or did any other shady shit you can call them out.

Once done safely store any screenshots/archives off that pc. Disconnect it, and any other equipment you have of theirs.

If they contact you in any way before you have spoken to a lawyer tell them that you are seeking legal advice and cannot discuss a thing. No coming in, no discussions over the phone, nothing. No returning of equipment either (better the lawyer handles the handover). Hang up if they continue to try forcing something.

Once you have a lawyer they will handle any communications and tell you how to proceed. If they still try to contact you only say they have to go through the lawyer regardless of what they have to tell you - no wisecracks, arguing, anything - just "My lawyer is XXXX and his/her number is xxxxxx".

Sauce: Fired in retaliation for complaining about unsafe conditions, got the company fined half a million.

If you are an "at-will" employee, you will only have a legal claim if the real reason that your employer terminated you is because of your age, ancestry, national origin, race, religion, color, disability, marital status, gender, sexual orientation, pregnancy, certain medical conditions, or because you reported some illegal or unsafe working conditions.

Short of the above circumstances, you have no legal recourse. And yes, they are free to LIE to you about the reasons for firing you, as long as they're not hiding a discriminatory termination. They can LEGALLY accuse you of doing something you didn't do, and even if you can prove otherwise, it makes NO DIFFERENCE. Because they don't need a reason to fire you, it makes no difference if they give you a reason, don't give you a reason, give you a shitty reason, lie about the reason, or are wrong about the reason.

Do some Google research if you like. You don't need a law degree to confirm what I'm telling you. Its spelled out on hundreds of websites because its elementary employment law.

Separate issue. They're offering him a severance package, which he has no legal entitlement to. They're offering him BONUS CASH, in exchange for agreeing to certain things.

If he wants the BONUS CASH, then he signs or negotiates the paper. If he doesn't, then he doesn't sign and gets no severance. No one is forcing him to do anything.

Common practice. For a small amount of money they get a release, which prevents people like you from filing frivolous lawsuits. Frivolous lawsuits cost the university money, even when you have no chance to win.

As for barring you from the school, that's unusual but I guess they just want to cover their ass. Of course, they can probably bar you from the school anyway, even if you don't take the deal.

Anyway, if you don't like something in the severance agreement but still want the free money, then be a man and negotiate it. Take out the part about barring you from the campus, or make an exception in the event you matriculate as a student. Or if this logical approach is too difficult for you, then hire a lawyer to do it for you.

I know it sucks that you never got a chance to tell your side of the story. Most HR people know enough the give people a fake "hearing" so that they feel like they had their proverbial day in court. Get a Tort or Civil Lawyer, not a Criminal Defense Lawyer.

Wrongful Termination, and Torts associated with Wrongful Termination.

If you can prove you did not do it (subpoena the data on the servers, or at least the redacted data that they used) you can show they are wrong, or at least that they have convincing evidence...if they continue to pursue termination in the face of "no evidence" then you have 'willful wrongful termination', which can prevent termination and increase collectible damages.

The first thing a good lawyer does is file an injunction against termination, and schedules a hearing for discovery or offers of proof...where each side establishes their bona fides.

I'm not sure how civilian jobs work exactly because i'm and air force fag. But, I know that in the air force it's IMPOSSIBLE to take action against somebody without producing the evidence. If they don't have the evidence, they're making a false claim which is illegal.
