are there any lawyers/ lawyers on?

my mother passed away very recently. and my brother as well (4 months ago). my mom had a life insurance policy in my brothers name, and she was named the beneficiary. i do not know if she named a secondary beneficiary ( i had hoped she had named me), so now we have an unclaimed policy that my step father thinks he's entitled too (he already got the house and the rest of the estate)

it is my understanding that in a life insurance policy that it should go to next of kin if the claim was not processed before the death of the beneficiary. however my step father is named trustee of my mothers estate and became executor of any policies and such.

Inheritance law varies from jurisdiction to jurisdiction, but surviving spouse often trumps next of kin. That may be what happened here.
