The reason Mugen and Jin can't kill eachother is because of the equal but opposite nature of their fighting styles, which is also a running theme in the series how similar they are despite their completely different personalities. Jin is too precise and immaculately calculated for Mugen to kill, and Mugen's unique style and inhuman tenacity makes Jin unable to defeat him. And regarding the final boss samurai, once you get to a certain point in skill it all comes down to the fighting styles and how they specifically stack against eachother; that's precisely what makes me wonder who'd win between Kagetoki Kariya and Shouryuu, the ki wielding shaolin motherfucker. Even though Mugen was able to kill him, it might not be possible for someone equally skilled in swordsmanship but lacking his unique methods in battle. That's also why I believe Jin would have lost to Shouryuu as well, you never know exactly how conventional and unique styles might clash.

Another difference between them is that Mugen isn't actually a samurai. Only Jin is a samurai by birth. And like many samurai he was traditionally trained in a particularly formal style of kendo by a particularly respected master (who's based on a real dude, btw)
