It's actually not illegal.
It becomes illegal when the plane isn't yours, and the action results in property damage that also isn't yours and/or damage to people.
If the terrorists had bought the planes, and bought the towers, then evacuated the area, flown the planes into the towers and then cleaned up afterwards they'd have done nothing illegal.
They might have needed demolition permits though, but if the towers were in the middle of no-where, people wouldn't have cared.
