Getting away with what? He's contractually obliged to appear if the production company asks him to. Like any other actor under contract there are penalties for no-show (he'd lose his SAG-AFTRA membership, for example, if he just didn't turn up to something he's supposed to be working on) and all any company with the right to force him to appear has to do is book their filming days around his schedule. So his choice as a 93 year old is to either keep his schedule so full that he can't get dragged off to wherever to film (which is much less fun than you'd think, even with guaranteed first-class travel and accomodation), or announce his retirement (which means no more con appearances, no more anything - and like anyone who retires completely and abruptly, he'd have a very short life expectancy then).
Beyond that his only hope is that every Marvel-derived movie made from now on is at a non-union studio, but that's not going to happen because non-union labor in filmmaking tends to be dogshit.
