The CW's LEGENDS OF TOMORROW will reportedly switch casts each season, and Matt Ryan has been tapped to reprise his role as John Constantine in season 2, which is slated for 2017. Steve R. McQueen is also talks to join the CW-verse as a new superhero.

Batman was in the TNT Titans script. HisHis fight with Robin is what leads Dick and Baby to go to another city to set up shop. Far as I know, TNT has shelved those plans, so Nightwing would be available for the CW shows.

Except this isn't true. Those statements were from months ago, and Blue Beetle, Booster Gold, Deadshot, Katana and a few others still had to be removed.

They said Deadshot isn't gone permanently and they're still using Waller, it probably just depends on the character. The direct references to Superman and Batman in the LoT trailer is a pretty good sign that they've loosened the grip.
