Rather than acting as if they are a criminal (a 100% certainty) it's acting as though they MIGHT BE a criminal (which is true for all people regardless of race). Knowing what percentage that possibility actually is given the person's race and reacting accordingly to protect yourself is not making an individual judgement on that person because to make an individual judgement, the probability would have to be 0% or 100%.
