Format either the SysNAND or the EmuNAND the old fashioned way (through the 3DS's "Format system memory" command)
I think there's a few extra steps you have to take if you're formatting the emuNAND or you lose everything and have to start over, so it is recommended to format the sysNAND instead, as that's a lot easier.
If you format the sysNAND, it's going to say you're going to lose everything. You won't. Just take out the SD card before it formats, everything you want to keep is saved on there.

You can update all the way to 10.3 on an o3DS, but only to 9.5 on a New 3DS.

I have all the files in the correct locations, and it takes a couple of tries to get into the downgrader, but when I press Y to run the downgrader the first step fails and I get this:

go to nintendo 3ds/numbers folder that's for your emunand/numbers/
in this folder there should be exdata, don't bother with that one, make another folder called dbs, enter
go to notepad, make import.db and title.db with nothing in them, place them in the folder
unplug sd, plug in 3ds, go to emunand, enter system settings, data management, 3ds software, let it do its thing

My 3DS keeps blackscreenign when I leave the SD card in and try to turn it on. When I take it out I'm good. I've just got to the step where the Health and Safety app is the title manager for big blue box without an issue but the whole black screening is annoying. if I delete the extdata folder (this means I will have to reinstall menuhax) will this cause any issue with Big Blue Menu and my moving foward?

It's actually fairly easy to keep everything in place on a new 3DS. Just back everything on your SD card up to your PC, perform the downgrading/CFWing/emuNANDing process, and then just put everything back when you're done. All your stuff will appear in your emuNAND like normal.
The biggest problem I've faced is a couple games I've bought don't want to jive with the downgraded firmware, but that's easily remedied by just downloading spoofed versions of those games.

I simply installed Menuhax with homebrew, now using the home button when ingame (where it should put the game in background and menu in foreground) doesn't work anymore. It freezes.
