He WAS taking directly from his father. (I forget the exact amount his father gave the con-man, $40? Lets say $40) He gives the man 40 bucks and the man asks Jimmy for a carton of cigarettes. They cost $10 bucks and the man gives Jimmy $10. Later Jimmy Pockets it. In the end his father is still out $40 dollars (The man has $30, Jimmy has $10) and a carton of cigarettes worth $10.
So that kind of hint suggests that it is not impossible, though rather unlikely, that Jimmy took money from the register. But yes, Chuck probably came to the conclusion based on nothing.

Anon, he literally scammed people out of their money and was nearly thrown in jail on sex offense charges, until Chuck gave him an ultimatum, and even a job working at his company. Chuck sacrificed two decades of his life to upholding the law, then suddenly his Brother passes an online bar exam and expects to be a lawyer for his firm.
He didn't hire him because he knows Jimmy's past and he knew Jimmy was still trying to bend and break the law, deliberately hiding it from Chuck.

That's not the same thing. Homer Simpson is likable but he's also an idiot with a terrible work ethic. It's not a business deal either, Chuck knows he's a scumbag and no one in the right mind in his position knowing what they did, would hire Jimmy as a lawyer representing their firm.
