It's not intentionally malicious; all of the evidence being found in her room is true and all of the circumstances pointing to her is true, so it's a reasonable defense to make that she's a more likely culprit. That was more of the prosecutor's work anyway. At worst, he could be found in contempt of court for not fessing up about "being the thief", but people love him so much they wouldn't go through with it, or just give him some minor fake punishment.
