So lets say you had an asset you bought for 1000$ and it now has a fair market value of 10,000 and you pass it on to your son when you die. When you pass it on your son can step up that assets basis up from 1000 to 10,000 and then when he sells it for the FMV of 10,000 he will recognize 0 capital gain taxes.
Now lets say you get your son that same stock with a basis of 1,000 and a FMV of 10,000. He then sells if for its FMV. He will have to recognise capital gains of 9000.
However congress thought that was dumb cause people where using it to step up there basis by alot so they passed a rule that what ever basis you include in your estate is what you will record as the basis.
Thus you only get a free step up for the amount of life time exclusion you have.
