I think Comey made a mistake in his reasoning or is very lenient in his way of thinking on purpose.
Comey's entire justification not to charge Clinton rests on three somwhat related things:
1. She didnt intend to break the law
2. It's not fair to charge her because other people under similar circumstances wouldn't be charged either.
3. Historically people weren't successfully charged or charged at all with negligience matters.
So the issue here is: Why is it impartial to NOT apply the law just because the law wasn't historically applied?
He argued that it would be celebrity hunting to charge Hillary Clinton. I think just because nobody has ever been prosecuted shouldn't mean that nobody should.
Why should he get to decide whether celebrity hunting is "unfair" and so that's why Hillary shouldn't be punished? It sounds like SJW tier logic. Instead of looking at the facts and looking into whether he could get a conviction, most of his arguments against pursuing a case are because he deems it "unfair".
So his 3rd argument is about whether he could get a conviction. But that doesn't seem to be around the facts either, JUST about how many cases had been persued so far.
That doesn't seem very objective. If there is a case, persue it. If not, dont. Don't look at why historically there hasnt been one and that's why it would be "unfair" to do it now to Hillary. Fairness is not your job to determine, you are paid to apply the law.
Then he seems to outright defend Hillary at times, for example when asked why Hillary deleted some emails before the FBI could get their hands on it. He answered "you delete to delete". So he doesnt even think that maybe there might be a problem there. No, it is just without motivation. She just deleted them so that they are deleted.
