Privacy laws. Specifically, a person has a reasonable expectation of privacy when not in a public setting, and taking their photo without their knowledge or consent is a violation of that privacy. Based on this lawsuit, that violation apparently extends to people publishing such media.
Remember that originally, Gawker was just asked to remove it, I imagine a large part of that one hundred million dollar sum is due to them blatantly rejecting a judge's orders.
