Actually, if the waiter does not at least meet minimum wage rates with tip then the employer is required to pay the gap. I agree that it is a stupid practice. Theoretically it is supposed to allow restaurants to charge less for the food since they won't have to pay employees as much. I'm pretty sure that the owners are just increasing profit margins now though.
