Because this has nothing to do with freedums, the US and China are beginning to clash because China is a rising power and the US is a waning power. The US wants to contain China which includes objecting to it's territorial claims despite claiming to be 'neutral' on the issue. China want's to be secure the SCS because of it's strategic importance. The Philippines and Vietnam are banana republics with no real legal claim because neither were sovereign nations when first the Qing and then first Chinese Republic claimed and enforced claims to the Spratly and Paracel Islands, yet the US is white-knighting them because theyre becoming satellite nations.

It's not moot if every successor government claimed the islands since and claim is enhanced when a nation begins to enforce it's claim. The First Chinese Republic claimed and enforced to varying degrees it's administration over the Paracel and Spratly's. Maritime Law doesn't really even begin to become relevant unless the islands are unclaimed and uninhabited , which doesnt really have bearing in the cases for Vietnam and the Philippines.
