It's not complicated. A couple years ago, the Comic Megastore offices got raided for not censoring their stuff enough, which was probably more of a mobster thing than a legal thing. It spooked the other companies to censor their stuff more. They've actually been getting a little more lax lately - compare some of the tanks that came out right after the raid from MSC, which got mega-pixellated, and now they're back to using bars (though a bit thicker than it used to be.)

They can download uncensored stuff just fine, but publishers who produce products for the Japanese market can face legal consequences if they don't censor their work. It's perfectly legal for Japanese companies to license uncensored versions to foreign publishers, and Nobody cares if Japanese people download those, but there might be a problem if Japanese publishers were obviously doing that specifically to circumvent censorship laws for Japanese customers. Ultimately it's the companies that are held responsible, not the customers.

They can't even buy uncensored DVDs abroad and try to bring them back, they'll get fined and/or arrested. Customs can and will search and open DVDs. I even heard of a couple who got arrested for trying to import their own homemade amateur porn, because it wasn't censored.
