iOS stores a hash, not your actual fingerprint, and it stores it in the secure enclave just like your password. There would be no way for the law to retrieve it using only the phone's data. But if they have your phone, they likely already have your fingerprints because they are either all over the phone itself or they have you in custody.

Your fingerprint is not protected under the constitution. You're within your rights to not tell the police your passcode. They are allowed to get your fingerprint though. So its completely reasonable to not want to use the fingerprint scanner
It's a growing trend that governments will just imprison you until you give them your passwords.
