I think I know what the real issue is, Bendis wanted so badly for this to be an equal argument but his utter ineptitude doesn't allow him to successfully pull that off.
We're all pretty much programmed to be team Free Will so he probably assumed everyone would just naturally be on Tony's side, so he put all the effort into making Carol not seem like a fascist future cop. She's only hunted down acceptable targets and this being the only real instance of overstepping and infringing on the rights of a relatively innocent individual she was civil with him and his death was purely due to the actions of a rogue agent and they're holding him accountable for said actions. The only stupid thing she's doing is trying to charge people for crimes they would've commit rather than charging them for the crimes committed already. Tony meanwhile only has emotional arguments and saying "it's just a theory". Meanwhile everyones chirping off all their arguments against how Minority Report ripoffs always playout without realizing they have no actual relevancy here.
