Hello /sci/, i'm being sued

I am a male OB/GYN fresh out of residency. 6 months ago I got a job at a private clinic. The patients are largely middle to upper class, and I love my job.

Since i'm a new doctor, the vast majority of the patients I see are for gyno and not obstetrics.

As a male gyno, naturally I get fewer patients. Our clinic has 4 full time MDs, 3 of which are women and me, who replaced a male doctor who was very much loved by the community.

Here is my issue: I'm being sued

As a male OB/GYN, I've faced a lot of hardships. There has to be a female nurse on hand for all the examinations for legal reasons. A lot of women prefer to wait months for the female doctors rather than see me. I can totally understand that.

The reason i'm being sued is because of a MtF trans patient. This person came for a pelvic exam two weeks ago. Immediately, this patient was hostile when I asked perfectly routine questions that I ask of any patient. A lot of their medical history was blank and it took a long time for me to piece together the information needed to give an accurate diagnosis.

From my standpoint, there was very little I could do for them. I specialize in female anatomy. A normal pelvic exam involves looking at the vagina, cervix, then examining the womb and ovaries....none of which this patient had.

So, i'm currently being sued for discrimination, from a patient who literally did not have the biological parts that I specialize in.

What should I do, /sci/?

Honestly, what did that patient expect?

They aren't gonna get a pregnancy test, they can't use birth control, they can't get cervical cancer or ovarian problems.

What the fuck.

There should be absolutely no case, you studied organs that the patient does not have. You should have said exactly this with zero reference to "female" and offered a recommendation to a more suitable specialist just as a general practitioner would for issues out of their expertise.

Keep in mind there are numerous reasons this patient may be mentally unstable (not a jab at trans, many of them are abused which fucks you up), but assuming you weren't a complete fucking idiot, you should have nothing to fear. Ask for advice from superiors, and good luck.

I'd be surprised if it went to court. If so, then you might be outed if they decide to settle, but that seems far off.

First and foremost, you shouldn't come to /sci/ or any 4chan board for legal advice. That's a big no-no. This being said, as >>17250918 said, your clinic you work at should be handling all legal bullshit for you. Since this is one of those piss-easy social justice cases that the clinic will have nearly zero trouble getting dismissed, they're not likely to fire you and find a replacement, especially considering how much of a bitch it is to find any single specialist in their hospital (thanks to the AMA there is a finite number of OB/GYNs willing to work in your area that are searching for a job). Now, if you were making off color remarks during the examination and the transgender individual had video evidence to support it, then you would be a legal liability.

During the pre-exam this patient was very adamant about their identity, and it seemed like some kind of ideological struggle. I'm guessing they just recently got legally identified as a female.

And from that struggle i'm guessing they wanted to do what most women do, and go to a gyno. I guess I was just unlucky enough to be there.

Since this is 4chan, I didn't really expect any meaningful advice. /sci/ is a bit more intelligent in my experience.

Mostly I think I just want reassurance about how ridiculous this situation is. My workplace is absolutely shouldering the legal responsibility, but moving from a multi-billion dollar medical corporation to a smaller clinical setting worries me. My current workplace doesn't have a team of lawyers to intimidate people :(

And for the record; I didn't make any off color marks. I just recently finished residency and the social climate has changed so much according to what the older nurses have told me.

I treated the patient with nothing but respect.

If you're just looking for the "am I boned?" question to be answer, I would like to tell you that you shouldn't worry about it. Nothing bad will happen to you, and you'll be able to continue practicing without incident. People sue doctors all the time, and the sue the fuck out of hospitals all the time. Just continue on with your life and they'll fuck off. Odds are (his/her?) lawyer will send some 5 grand settlement deal to the clinic which they'll accept because it's cheaper than the legal fees.

Based on experience, I know that a lot of medical practices get hit with frivolous lawsuits all the time. This is just the first time that I was specifically targeted for it.

The potential money loss isn't even what i'm worried about. I genuinely care about medicine and helping people. Maybe thats because i'm young and haven't become jaded yet.

It's common to be sued along your medical career, you just have to take notes in every medical-patient interaction to show you did things right in case of trial. This trans person may have personality problems too, this shouldn't undermine your confidence.
