For emuNAND 9.6+, you need access to the OTP registers, which are locked off on a hardware-level (severing the connection is infeasible -- it's inside the SoC) before arm9loaderhax payloads can even activate. With the OTP registers, you can generate the key required to decrypt the NAND region at 0x12c00, which contains the key material for N3DS 9.6+ firmwares.
Until you get into the OTP region, you don't get the keys required to decrypt 0x12c00, and until you can decrypt 0x12c00, you can't derive the keys for 9.6+ firmware.
