Two games that are both in the monster collector genre closely follow the standards of that genre? No way anon, this is some crazy news here. I guess that makes damn near every 2D fighter ever made a rip off of street Fighter. Even if Pokemon and Digimon have a lot of things in common they're still pretty different in terms of aesthetic and world they take place in. You cant just say "You collect and fight monsters, so they're exactly the same".

Digimon is at least different in terms of mechanics and the world it takes place in. It's similar on a base level, collecting and fighting monsters, but doesnt make it a rip off.
