It's not Software looking better.
It's just that Software turns off texture filtering.
Textures look better unfiltered when they are low resolution.

+ the all different, animated water texture on Software mode looks miles better than the static, wobbly surface on D3D / OGL

Oh and to add to that, you can play in hardware and turn off texture filtering with a simple console command.

You've got them confused son, it's the other way around.
Hardware has 3D water + all those ripples effects.
Software only has the latter in less accurate form.
