Activision gets Orion pulled from Steam over stolen assets.

>Trek Industries’ open-world sci-fi shooter Orion has been pulled from Steam, thanks to a DMCA takedown request, according to the game’s developer. The game allegedly uses certain assets from Activision’s Call of Duty: Black Ops 3 and Call of Duty: Advanced Warfare.

>David Prassel of Trek Industries posted an update to one of the studio’s other games on Steam, Orion: Prelude, saying Orion (aka The Orion Project) was pulled from sale after a copyright claim.

The head dev for Trek is a well know Russian piece of shit. He's been caught constantly stealing assets from other games before. Been doing it for years actually, since all the way back in the Half-Life 1 modding days.

This gun isn't even the worst of it. In the cash shop for Orion, there are a shit ton of copyrighted hats that are assets ripped straight from other games. They're straight up making profit off those.

Composer Marcus Zuhr is another claiming to have been burned by Spiral during development of the game.

David used me, my contacts, and my music to further his agenda for over a year. We had fairly lofty profit sharing agreements at the time, including a salary and company shares. I set him up with many meeting through my own industry contacts, and flew from Canada on my own dime to help in San Francisco and Seattle multiple times on business. After his successful Kickstarter (utilizing my music of course), and our meetings at GDC 2011, he promptly "fired" me. David continued to use my music, against my will, until I properly threatened legal action.

Not too long ago, a video was released of Orion: Prelude containing what looks to be an exact copy of Natural Selection 2′s armory. It was quickly made private and a new edited version put up when people started questioning the origins of said armory. News quickly arose that the armory was an “inspired” placeholder which had made its way into the demo build for PAX.

This isn’t the first time Spiral Studios had been accused of stealing content. Many alleged models and weapon sounds (which have an uncanny likeness to Counter-Strike might I add) are said to be taken from countless other games, and this has been a constant throughout the development of the Orion series. According to some, they took a T-Rex render from Primal Carnage and skewed the portions slightly, retextured it, and redid the head. You don’t need sharp eyes to spot just how similar the models are; just by looking at the feet and scales you can tell it’s a copy/paste job. I can imagine Spiral Studios’ lack of appearance at the Game Developers Conference was sorely missed by many an indie dev who were ready to shower them with praise and placeholders alike.

When you have copyright on a piece of art - like a model - you don't own everything that was ever or could ever be inspired by that art. You don't even own things that are your art but slightly different.

All you own is the exact thing that you made. If those models are not 1:1 copies, or substantially similar (i.e. 1:1 copies with different lettering) then the copyright holder has no claim.

Copyrighting H2O doesn't give you a copyright on H3O or 2HO.

That's the issue. And as it stands, Activision aren't entirely groundless. Damn, I even had appreciation for his company. The way they listened to criticism and feedback and remade the game many times until it was good enough was great. Not many companies are willing to put that work into a 1 dollar product. Most people instead of finishing the game, would just start a new one.
