Now then, this has solid legal standing in the U.S., and there is precedent. From the most basic legal standpoint, a transaction where something is sold for little or no cost cannot be rescinded by the seller after the fact. There are notable exceptions, but in this case none of them would apply. XBL and PSN give out free games each month, and it is not unreasonable to believe that this could have been a part of that. The only way they could really attempt to defend themselves should folks take them to court over this is if they have something in their EULA that covers this. Even then, that can be overturned, as EULAs are of questionable legal binding.

If I was Microsoft I could argue that there was no intention to create legal relations because the price was a mistake, and people who attempted to enter into the contract must have known it was a mistake because games like Fallout are never just "free" (seriously, when was the last time one was?). I could also argue that processing the order, confirming the order, charging customers, and enabling their accounts to access the license, being automated systems, do not constitute acceptance of a contract of sale. This would be more difficult. When dealing with online deliveries of physical goods the contract isn't actually accepted until the goods are physically delivered most of the time - companies receiving payment do not constitute acceptance most of the time - but this being a digital good the same principles MIGHT apply - that it is an automated system and therefore the simple act of the system doing its thing doesn't constitute the company accepting the contract.

Ergo, no contract of sale, and the customers must return their licenses.

Companies are not obliged to honour mistakes. Advertised prices are an invitation to treat, not an offer. An offer is made by customers to companies, and it's clear that Microsoft doesn't want to accept this offer even if their automated systems are working as intended.

Store I worked in once had a power cut, to get people out the store a few people just were allowed to leave with the shit in their trolleys.

So an unforseen problem meant people at one brief period got something for nothing. This is literally like 12 hours later the staff then came to people's houses, said we're taking all this back now because we've thought about it and decided that good will gesture was a bad idea, here's ten dollars instead and a big fuck you.
