It was a fan animation, but at the same time, still using their images and sounds, which is how EA managed to do a takedown on a recent Donal Trump "Trump Effect" trailer edit, since they claimed it used unedited audio from ME 2's trailer.
It's like... not really covered at all under fair use for stuff like Abridge series, who essentially just redo the audio but keep the source material the same. Same deal as this animation, which shows the guy just throwing extra stuff in from other games on top of a normal playthrough of Mario Kart.
Sucks, but they have the right to do it, and exercised it, even if it was in poor taste. If the guy submitted that to the "30 years of Mario" deal, and released all his rights to the vid, Nintendo wouldn't have touched it at all, but eh, what else is new from the company seeking to copyright the coin sound from Mario, so they can have Youtube and other services patrol for its unlicensed use? All about dem coins, even if they're just hypothetical potential ones.
After the Nintendo NXT fails they will no longer be a hardware developing company. They've made too many mistakes and they are heading in the wrong direction. In the end they will become a zombie company whoring off their IPs like Sega.

The difference is that Nintendo has a ton of likable IPs to whore out, while Sega mostly just has Sonic (and his friends that people can't decide if they love or hate em as separate DLC these days)
Seeing as Nintendo is opening the floodgates for IP whoring with theme parks, movies, possibly TV shows, mobile games, and other things, they have at least another decade of free money before really having to consider going the way of Sega and becoming software only.
Just like the Wii U, Nintendo will secure so much dosh in their coffers due to some of the stupidest shit that they can wrangle out of their fans, that it doesn't even matter if they make the most ass-backwards hardware and gimmicks around next go around.
