Seeing a lot of wishful thinking and ignorance on the appeals process and Gawker's chances there. Gawker does not have to pay $115 mil to get an appeal, that amount gets capped at $50 mil. However, that $50 mil can be waived entirely by filing an appeal to have it waived. Considering Gawker doesn't have $50 mil liquid and that it might destroy the company to get the $50 mil, they have a chance, though who knows. I don't know how often things of this sort get waived.
Beyond that, Gawker is right in that the previous court rulings have been in their favor, hence why Hogan had to drop the initial copyright suit and then refile a new suit in Florida.
