There was no hardware on 3DS for emulating SNES games so it would had to be software based emulation which is very taxing for a console like the 3DS i even doubt the N3DS is capable of handling some of the latest snes games.

Probably, though you have to remember that each Virtual Console game is made with its own emulator to ensure the game runs properly on the hardware. Beats having just one piece of software trying to run every single thing, since the emulation tools Nintendo uses are tweaked specifically for each game.
o3DS is too weak to run SNES games. This has been stated many times before.
As a side example, this also extends to GBA too, and why the GBA VC is only out on Wii U right now. The Ambassador games aren't normal VC games; rather, since the architecture behind the GBA and 3DS is still largely the same, the 3DS just clocks itself down and simulates the GBA hardware, technically doing the same thing it does when playing a DS game. This is also why you can't do things like enter sleep mode when playing an Ambassador GBA game. They have to do it this way because the 3DS can't actually emulate the 3DS, it's too weak. It's because these drawbacks exist that Nintendo doesn't release GBA VC games for the o3DS, as they can't make the GBA games function a normal VC title.
That was a bit off point, but I figure answering a similar question that's also been bothering other people could help make it more apparent that, as I've stated at first along with others before me, that the old 3DS really is too weak, as hard as it is to believe.

It's fine for emulators to run games like shit because they're free. It's not fine for a game a company is charging $10 for. Even PC emulators have some issues running certain SNES games. You also have other issues present in emulators that don't deliver the same experience, such as missing backdrops or translucent scenery that doesn't mesh. These are actual ports that run the games flawlessly, but obviously require the better hardware.

No. Borrowing a game is not like a demo. When you buy a game you have ownership. Included in ownership right to lend the video game to anyone you wish. You're extending your ownership to that person until the time when the game is returned. This right is applied to everything you own from books to cars. The only reason there is any confusion about this when it comes to video games is because of DRM, digital rights management. Your right to lend or sell your games is protected by law, but digital media has special allowances to remove those rights from the owner. Why is this allowed? Because digital media is so easily duplicated. Lending becomes permanent ownership. And that became piracy.

I'm not an expert on the subject, but emulation isn't the same as hardware rendering as you are actually emulating the original hardware of the snes and not just the games. A 3ds could flawelesssly play any snes game if they got properly ported to the 3ds hardware.
