Assuming you're talking about using Daiz Loader yes you can do the free upgrade, but once you do a clean install it won't be recognized as legit I don't think. The fake OEM partition table is the only thing keeping it genuine. A clean install wipes that out.

If you use windows and break the law you are so dumb you deserve to be put in jail. You can easily dual boot and break the law all day on Linux. Using a legacy OS just because you're too lazy to upgrade isn't a real argument.
