From what I've heard, Japanese were aware of Panda, and send them DMCA at around the same time they did to Fakku. Panda didn't do anything at the time, and Fakku pushed for going official.
Later on the publishers emailed them again, now with legal threats, so they couldn't really do anything but comply.
