Why would they be C&D'd years after operating publicly, when Nintendo was always fully aware of them, deleting miiverse posts about it and making tournaments remove them? If Nintendo wanted to do something about them they would've done it sooner.
Everything that was leaked from the team says otherwise, they wanted to cut ties to it not because legal trouble happened, but because they were afraid of it happening.
