/v/ loves to go insane about anything, but like normal it's more subtle then either side gives credit. There is a genuine issue, but it's not universal either. The bigger and more mass market something is, the more likely they are to care about normals and overall PR. Something like FF7 would be at the extreme end of this: they want to sell a gazillion copies, and ANYTHING that wants to sell a gazillion copies tends to end up more generic and "safe".
At the opposite end though there will continue to be a healthy market for vidya that's cheap to produce and in turn only needs to sell a few thousand to few tens of thousands of copies to make a profit. Since they only care about the core audience and don't give a single fuck about the wider population, they can also do things that the general population wouldn't like.
You see this basic economic dynamic everywhere. Anime tends to be much safer and broader appeal then manga. By the same token anime is much cheaper to make then live action or cinema.
Ultimately in America none of this is a matter of law, just economics. So there will always be room for us to maneuver.
