I make ~40k a year; I make software for games and have to fight for my copyright around once every 3 or 4 years.
I usually file suit (<1K); wait for them to counter, file remand on counter; wait; continue with life (usually takes a year for them to realize that I already know all the steps to the dance) wait for them to make an offer, either accept (yay bonus 200K-400K) or deny and ask that they stop using it and that profits be donated. 99% of the time, they don't take it beyond that, accept either giving me money or giving money to donation and move on; its way more trouble to fight little guys that don't give a shit than it is to pay a new programmer to make new shaders. If the emulator developer hasn't defended his copyright before, it's forfeit now. That's why the Fallout poster guy got sued a few years ago: If Bethesda didn't defend their copyright, they would've forfeited it.

Also, Steam can just say "we're selling the game but packaging the emulator with it for free so people don't have to download separately it to get the game to run".
