Flash carts are specially designed hardware that fool the system to believing it's interfacing with a legitimate cartridge, the same way modchips fool a system to believe a CDR is authentic. I'd argue that they're not really mods at all because they do not modify the system whatsoever, but insofar as the cartridge is considered part of the system (and older systems certainly needed cartridges in order to function), then it is much, much closer to a hard mod than it is a softmod because it's modified hardware and not an OS or kernel exploit.
Not only are SD carts and HDDs not modified, they are standardized containers which the hardware was designed to use. Instruments perhaps necessary to implement the soft mod, but they are not themselves the modification and you typically don't even need them afterwards. Unlike flash carts

It varies by system. Gamestop does not update used or refurbished systems, so it's a dice roll. You can always just return the system for another (30 days) or full refund if it's within a week and try again.
