One thing I recall happening to many H games after Rapelay was pulled was the ratings board that only handled H games no longer allowed the theme of rape. Japan basically has this ratings board for its H games, but it's optional. The thing is though that certain stores won't sell your shit if you didn't put it through the rating system, so you had to either conform to the board's ideas and write your script around it. This is why so many games do the whole "everyone is over 18, even the lolis" deal. It's a cabal, basically.
With digital distribution many developers are able to get around it now, but people typically don't because it means less exposure for them.
