If she either claimed she was over 18 at any time in the chat or never said how old she was, nor did the police during the decoy chatting (which they would need to use as evidence in a trial) then he never would have been convicted. Even a shitty public defender could poke holes in that. The dudes mom os probably middling the facts to make him not look so bad.
