The anti-Seinfeld case is aimed at what functional impact the episode has TODAY, not what its actual or intended impact was when it was first broadcast.
To bring it back to your example, if we consider something like I Spit On Your Grave (the remake). The pro-ISOYG case would be: Look, this is a movie about a woman who is brutally raped, deals with the massively traumatic impact of that ordeal, girds herself up, becomes totally self-empowered and goes on a murderous revenge rampage. How is that not awesome?
The anti-ISOYG case is "It offers no exploration of the actual issue of rape, or of its causes, or of its impact, or of how society deals with it, presenting only a fantastical, wish-fulfilment resolution. As such, it exists solely to exploit the emotional impact of graphic depictions of rape."
And in that case, I'm basically in the anti-ISOYG camp (not that I'd support banning it or whatever). It's clearly just using the phenomenon of rape as a sales ramp. No point pretending that's admirable.
