Vader admittedly isn't in the actual military hierarchy, but up until just a bit before the Death Star is finished he operated with autonomy essentially before the Emperor reeled him back in and placed him underneath Tarkin. Before that Vader could do whatever he wanted, violating the chain of command ten times a week, that's the Vader we see in Empire essentially because all the Moffs and top admirals just got wiped out.
