That was implemented later actually, and we got comics with the punisher killing a shitload of people under the comics code. I don't have the dates straight at this time but they implemented the no-kill rule relatively early on compared to the comics code specifically so that batman and superman could fight recurring villains instead of generic mobsters or petty criminals all the time.
Why are all the manchildren crying about batman killing a few people? "Oh no, my favourite super hero!" Killing bad guys is actually good, he takes them out of the equation for ever and there is no chance that they will escape prison or police interrogation whatever (high tends to happen a lot at DC).
