The court of public opinion has already decided and doesn't care about facts (which do not particularly favor Republicans anyway). If they were good politicians they would have known what was going on, read the recent polls, and submitted a proposal that was actually reasonable rather than one that places untenable strain on the judicial system. But, again, congressmen (on both sides) are generally pretty stupid. This time the Democrats win in the eyes of independents and even some moderate Republicans because Republican policy for the past two decades handed them it.

Yeah, sorry, that's not how due process works. Never has and never will. Courts are arbiters of judicial conflict, not omniscient overseers. Policies of systematically restricting rights through administrative means based on legislated criteria are the way government functions. As long as there is a means to appeal for judicial review, due process is not violated (although, as per the name "due process" certain rights have elevated dues). Judges do not rubber-stamp every minute step in the machine.
