The 9th district court reaffirmed that states that do not issue CPL to their citizens can continue to do so (like LA county).

Those counties/states that still allow CPL to be issues are not at all affected.

Ruling allows California to restrict carry of firearms outside the home to open-carry only.

Other states are not affected by California's laws.

It does open the door for other liberal states to pass open-carry only laws, however. Laws that will hold up in court.

not a valid court decision, it will be overturned.
>The interpretation of the laws is the proper and peculiar province of the courts. A constitution is, in fact, and must be regarded by the judges, as a fundamental law. It therefore belongs to them to ascertain its meaning, as well as the meaning of any particular act proceeding from the legislative body. If there should happen to be an irreconcilable variance between the two, that which has the superior obligation and validity ought, of course, to be preferred; or, in other words, the Constitution ought to be preferred to the statute, the intention of the people to the intention of their agents.

>Nor does this conclusion by any means suppose a superiority of the judicial to the legislative power. It only supposes that the power of the people is superior to both; and that where the will of the legislature, declared in its statutes, stands in opposition to that of the people, declared in the Constitution, the judges ought to be governed by the latter rather than the former. They ought to regulate their decisions by the fundamental laws, rather than by those which are not fundamental.

http://talkingpointsmemo.com/livewire/appeals-court-no-2nd-amendment-right-concealed-carry

Check the comments:

"I disagree quite strongly with Heller. Scalia was pulling shit out of his ass on that one, in big, big ways to overturn centuries of precedent.

There is NO constitutional right to self protection. None. Its not mentioned or alluded to anywhere, including in the 2nd Amendment. And Scalia hung the entire decision on this nonexistent right.

He basically erased any mention of militias..which is the entire reasoning actually given in the text of the 2nd Amendment.

He rewrote the 2nd Amendment (while claiming to be strict constitutionalist and that the that Constitution is "Dead, dead, dead!") to suit some fantasy version he kept in his head, and in the process created brand new rights out of thin air.

EDIT: And btw, this case wouldn't include Heller,as even in Heller, Scalia quite clearly said that state can and should still regulate guns."

And we're supposed to believe the lie that a complete ban and confiscation is not the end goal? What a farce

If Hillary is elected president, the liberal justices will just affirm the ruling of the ninth circuit.

Currently, even if they split 4-4, the ruling would still be upheld.

It doesn't really what the Constitution says if the Supreme Court decides to interpret it in a way counter to the meaning.

I'm saying this as a person who things the ninth circuit's decision is a disgrace.

I'm generally against gun ownership but I have once felt that I'd be better off with a gun. Say you angered some local gang, police can't watch your back 24/7 so a gun would be helpful. oh they very much did say exactly who should do it.

legitimate changes to the constitution only occur through the act of congress. for these changes a super-majority of both the house and the senate must be achieved with a final veto belonging to the president of the United States.

If said president Veto's a law and the people still want it, then both parts of congress must pass it with a 3/4 majority in both (not total, literally both house and senate need at least 3/4 each). If this actually occurs the president is incapable of further vetoing the law and is obligated to enforce it.
>>
>>76668737

Yes, there have been many instances where people open carrying have had their firearms stolen by armed thugs who want another gat, and have had the police over-react to a legal behavior, which happens frequently where I live because soccer moms just call 911 and say there is a madman wearing X,Y&Z pointing his gun at babies and school buses.

CC is great for everyday, I personally CC everywhere. Either a little subcompact like my Ruger LCP, sometimes a Glock 27, and in the colder months I will carry full size and compacts like a 1911, Glock 19, and Sig P320C. Doesn't matter if I am at work, shopping, or eating out, I have the piece of mind that my Wife and Kids can rely on me to defend their lives.

As for Open carry, I don't hate it, but I only ever OC when I am hunting, at the range or hiking. It has its place, but I prefer to keep it concealed.

You should read this post because facts.

9th circuit ruled on a technicality.
>case was brought solely on the matter of concealed carry laws
>there's existing case law upholding concealed carry bans (from 1850 no less)
>the twist is that case law includes explicit open carry rights in the concealed weapon legislation
>since the case, as brought before the court only related to concealed carry they ignored the fact that open carry is illegal in California, and ruled that concealed carry restrictions are constitutional
They state as much in the majority opinion that their opinion in no way relates to the question of open carry via this direct quotation:
>We do not reach the question whether the Second Amendment protects some ability to carry firearms in public, such as open carry. That question was left open by the Supreme Court in Heller, and we have no need to answer it here.

The problem is that we're not clamping down on illegal guns. Chicago has had 246 people shot and killed and 1374 shootings so far this year. They've cleared barely 20% of those homicides and their clearance rate for shootings is in the low single digits. Despite this, if you get picked up as a felon with a gun in Chicago you're likely to get probation. Theres no serious attempt to crack down on straw purchasers. Theres no sweeps of known gang members looking for guns, no stings looking for sellers, we're not even frisking known gang bangers suspected of selling drugs anymore.

Everyone pisses and moans about gun crime, but we know where its happening, who is involved, and we don't do shit. Another law that isn't going to be enforced won't change that.

Leftist gun control is not about results, it is about controlling the American populace, and making them dependent on the structures of the state for their every need. If they had any shred of real concern for reducing real gun violence, the National Guard would be called into Chicago until rule of law can be reestablished.

But that's not their goal, and it's not what you'll see. What you will see is constant attacks and erosion of the rights of the American people's self-determination.

Or you can be a cracker and carry w. no permit but use a holster.

In my state, Virginia, illegal CCW is a misdemeanor. You'd get a small fine and probation (second time is a felony, so don't get caught the first time).

If you have a permit, they know you have a gun to steal. You are making yourself a target. The Roanoke Times printed the names of all the CCW in VA. Better to be a scofflaw.

The national firearms act was passed in 1996. I was pretty young so...
Before that the federal government played very little part in firearm legislation at all.

There was one shooting (that some to this day feel was a false flag) and the media immediately blamed guns. That night the law was passed without a vote and the public was bombarded with anti-gun propaganda non-stop for ten years. That's why you get so many anti-gun australian's making fun of american gun culture here all the time.

They aren't just making jokes they actually believe in that shit because they have been brainwashed to be extremely anti-gun.

In 1998 in my state they even passed another law called the Weapons Prohibition Act which basically says you can't carry ANYTHING with the intention of using it as a weapon including for self defence. This includes in your own home. If you have a baseball bat next to your front door in case someone tries to get in and you hit them with it and you are dumb enough to tell the cops you kept the bat next to the door to hit someone if they tried to break in you will get charged for possession of an illegal weapon. That's how fucking tight it is.

Not to mention out self defense laws are written like vague fuckery. Basically if a judge "feels" like you used "excessive force" to defend yourself or you home or your family you can be charged with assault, manslaughter or murder.

The buyback program cost australian tax payers $500 million since one of the few things written in our constitution that is actually good for the people states that the government must give "just compensation" for any private property it acquires.

The buy back was compulsory so if the police got word you had guns and weren't turning them in they could search your property and then charge you with illegal weapons charges. Legal gun owners don't want that hassle so most people just handed them in.

$500 million might not sound like too much money by american standards but you have to remember that there was only 18 million people in australia in 1996.

So the government claims it bought $500 million worth of guns off of 18 million people. That's like 27 million dollars worth of guns per person.

Now that is some complete and total bullshit.

We had no say in any of this. People are too stupid to look at the numbers themselves. The government just makes a "muh feelings" argument and bombard the people with shit like "we don't want to be like america they have a school shooting every week" nonsense non stop.

I will agree with you to some extent however London is 12% black. Bad gun control has a hand as well. Black or white if you're a criminal your guns should be seized, end of problem.

Did you know that Cho, Rodger and friends bought their guns legally even after being diagnosed with a shit-ton of mental illnesses? Bad gun control.

At least you've sort of changed my mind on the issue, I'm not completely anti gun anymore seeing as you pointed out that urban blacks are causing the problem. But there still needs to be more stringent checks. Gun ownership free of all government interference is an unattainable fantasy because some people will ruin it when not watched.

Literally brainwashing.

That's it, that's all it is. Brainwashing is real, it's done through mass media - tv shows, movies, radio, videogames, advertising. It preys on your subconscious understanding of the world by feeding you false stereotypes. They grow up seeing behaviour A creates outcome B in TV shows, and then when they encounter behaviour A in real life, they assume the outcome will be B, but in reality it is more often C or D.

A very simple example: There are a lot of people who believe cars regularly explode and do so in dramatic fashion at the slightest accident.

Exploding cars are one of the biggest hollywood tropes, but people aren't often exposed to car accidents and while they may "understand" that TV isn't real, they still accept whatever they see on TV as real until real life proves otherwise, and so there are a lot of naive individuals out there who honestly think cars explode like they're filled with TNT, only because that's what they've always seen in movies and TV.

That is what all these liberals are: Literally brainwashed naive children who have never grown up to see what reality is like, and worse - as they get older they start actively avoiding reality; creating hugboxes, safe spaces where they won't have their understanding of the world shattered by reality.

Being a liberal, a leftist, or SJW, is being brainwashed and mind controlled.

By restricting the rights of the mentally ill, you discourage them from even seeking diagnosis, much less treatment.
Compounding that, going by opinions espoused in some left-leaning groups, the desire to own a firearm is indicative of a mental illness anyway.
Finally; the crimes you aim to prevent are, while absolutely tragic, rare but bureaucracy operates in systems and isn't equipped to handle outliers with any precision.

To argue from a different point of view, I wouldn't trust the same government has defied it's own definitions to keep marijuana a class 1 controlled substance to judge which disorders should disqualify you from which rights and for how long.

DC has rigid gun control and so does California.
You know what states are the safest in the US? Maine and New Hampshire. Both have no restrictions other than the federal ones, constitutional carry (no need for CCL) and the latter doesn't even have a minimum age for gun ownership.
You should also take a look at Czechia and Switzerland, both have very light gun control, but are safer than your country. The problem is niggers and (lack of) mental healthcare, guns don't make a difference.

I'd rather conceal if the point is to protect my life and that of others. When I'm hiking for days in the woods, I have a duty holster. If i'm somewhere like the woods or a ranch, I'll open carry. If I'm in the city, I conceal that shit.

that's a good one too -- wtf was he doing, just walking face first into a drawn handgun?

>If he hadn't been concealed, more than the dindu would have died that day
Had he been open, the dindu might have moved on.

You are a cop i take it. How many muggings are committed against people openly carrying a gun vs people concealing a gun? How many bodies turn up because an open carry fired on a criminal vs how many bodies show up on a criminal who was shot by conceal carry?

I respect what you do. We can't let cops dictate laws though, because they will always want to dictate laws that make their job easier. I am sorry. Vigilantes knocking off petty criminals is good for you, but not for me.

Did you hurt your shoulder fisting yourself?

Even f you don't anymore, the momentum alone must be exhausting when masturbating. No wonder your arms are so thick.

my cz 75 B leather hoslter sucks.

its a minute men and many time that i practice with it.

The fucking holster comes out of my pants.

Mine is this one but for cz 75 b .

And yes im big enough and wear the right clothing that i can conceal carry the cz 75 b.

Also i really fucking hate seattle.

Me and my non fag coworkers were talking about guns we want to own and shit we fired and just guns in general.

And this faggot 40 yr old virgin who lives with cats as the closest pussy he will get says

"is this really the main topic of the day?" and i was like "no but its a conversation between us 3" and he gets all moody like a fag and after a minute goes "thanks Anon for being so considerate"

If i did not care for this job i would have called him a fucking idiot who needs to mind his own business nobody was talking to his dumbass and if it was not inappropriate to talk about our legal hobby.

i cant wait to go back to GA! just 3 more months. i want to go with at least 11 grand.

There are enough guns in America for each and every citizen, you want to make it more difficult because of 3 different people.

The reason we dont want that is because we dont want the government knowing who has a gun, in case stricter gun control is passed.

It has just as much to do with privacy as it has to do with the guns themselves.

>Had he been open, the dindu might have moved on.
a lot of maybe's. most likely, if he really fucking wanted that money, he'd put thegun to your temple and ask for what's in your holster. Think of it in OODA algorithm fashion. If someone is going to threaten death/harm, your best advantage is the element of surprise. Give that up, you become a neon sign.
>You are a cop i take it.
Nope.
>How many muggings are committed against people openly carrying a gun vs people concealing a gun?
Lots of officers have their guns taken from them each year. Darren Wilson famously nearly lost his that day, and he was sitting "safely" in his vehicle.
>Vigilantes knocking off petty criminals...
I'm not a cop man, I just know how easy it is to die and what deranged crackheads are like. I got stabbed when I was in my early 20's working a job as security at a club. It happened fast, and I was unarmed, so i had to fight/run open handed, bleeding all over the place. I'll never be unarmed again, that was the lesson I learned. I don't give a fuck about shitheads who risk the lives of others, i'm not preoccupied with idealistic fairytales about sacrificing myself so subhumans can keep parasiting off society and ruining the lives of peaceful people. If someone comes for me over a cash register or a wallet, they're going to Valhalla.

Little bit. As you can clearly see i speak my mind. Some weaker people tend to take great offence to some of my insults and get violent. I am a decent fighter though, so they almost always get shamed. I am worried about one of these weak losers pulling a gun out of his belt and shooting me in the back.

> i had to fight/run open handed, bleeding all over the place.
A concealed weapon would have let you fight back. An open carried weapon would have prevented you from getting stabbed.

The thing about the California ruling is that they ruled previously that you can't open carry guns. Then they ruled that you can't conceal carry guns either, but judges have ruled that telling people they can't have guns violates the 2nd Amendment.

As we all know, the 2nd SHALL NOT BE INFRINGED so the left has got some serious doublethink to overcome here. They either want people to concealed carry or they want people to open carry. They cannot ban both because banning both effectively infringes the 2nd amendment.
