You can tell how he doesn't think he shot him, he called in that he was refusing to get out of the car, the misfires that hit him were a lucky shot. If the cop really was aiming at him he would have aimed for the chest, a headshot on quick pull out like that would be just fucking stupid to try to hit, it would be the chest area for the kill.
Also this was a drunk driver who ran from the cops. Of course the cop is going to pull out his gun incase the idiot who was drinking and driving tries to kill the cop.
